1. Introduction and Acceptance of Terms
Welcome to ByteMarkDigi. These Terms of Service (“Terms”) govern your access to and use of the website at https://bytemarkdigi.com (the “Website”), your purchase and use of digital products offered through the Website, and your purchase of any related services.
The Website and its products and services are operated by ByteMark Digi LLC (“ByteMarkDigi,” “we,” “us,” or “our”).
By accessing the Website, placing an order, downloading or importing a digital product, or purchasing a service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website or purchase our products or services.
You must be at least 18 years old and legally able to enter into a binding agreement to make a purchase.
2. Products and Services
2.1 Digital Snapshot Products
ByteMarkDigi sells digital business-system templates known as “snapshots” for use with the HighLevel platform. A snapshot may contain some combination of funnels, forms, workflows, pipelines, calendars, custom values, and other components, as described on its individual product page.
Each product page identifies the snapshot being offered and describes its included features. The product-page description at the time of purchase determines what is included in that purchase. Illustrations, mockups, and example images do not represent additional deliverables unless the product page expressly identifies them as included.
A snapshot is a digital template intended to assist with setting up business processes. It is not a promise of leads, appointments, sales, revenue, or any particular business result.
2.2 Separate HighLevel Account and Third-Party Costs
ByteMarkDigi snapshots are designed for use with HighLevel. A HighLevel subscription is not included in the snapshot purchase price.
You are responsible for obtaining and maintaining an eligible HighLevel account or sub-account, as well as any required third-party accounts, subscriptions, telephone numbers, email services, messaging credits, domains, integrations, or other services needed to operate your system.
The availability and operation of HighLevel and other third-party services are subject to their own terms, pricing, technical requirements, and changes. ByteMarkDigi does not control those services.
2.3 Optional Installation & Configuration Service
ByteMarkDigi separately offers Snapshot Installation & Configuration for a one-time fee of $297, unless a different price is displayed at checkout.
The service covers installation of one purchased ByteMarkDigi snapshot into one eligible HighLevel sub-account. It includes:
Importing the purchased snapshot into the agreed sub-account.
Configuring included components using the business information and preferences you provide.
Basic personalization of the included funnel with your supplied logo, business name, contact details, and images.
Functional testing of the agreed setup, identifying any outstanding items, and explaining any customer-owned connections or approvals still needed.
A walkthrough and handoff of the completed setup.
The service does not include a custom website, new workflows or features beyond the purchased snapshot, substantial cleanup of an existing account, third-party charges or subscriptions, or ongoing management and support. Additional work requires a separate written agreement.
Snapshot purchase and Installation & Configuration are separate purchases. Buying a snapshot does not include installation, and buying installation does not include the price of the snapshot or a HighLevel subscription.
3. Orders, Prices, and Payment
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, if any, will be shown or calculated as part of checkout.
You agree to provide accurate purchase and contact information, including an email address you can access. You authorize the payment processor to charge the payment method you provide for the amount displayed and accepted at checkout.
We may contact you to resolve an order or payment issue. We may decline or cancel an order when reasonably necessary, including where payment cannot be verified, an order appears fraudulent, or we cannot provide the purchased product or service. If we cancel an order after collecting payment and have not supplied the purchased product or service, we will refund the amount collected for that undelivered item.
Payment-card information is processed by our payment-service provider. ByteMarkDigi does not ask you to send payment-card details by email.
4. Digital Product Delivery
Following a successful snapshot purchase, we will send a private snapshot import link to the email address provided at checkout within two business days.
Delivery is not instantaneous. Business days exclude Saturdays, Sundays, and U.S. federal holidays.
You are responsible for providing a valid email address and checking your inbox and spam or junk folders. If you have not received your import link within two business days, contact [email protected] with your order information.
An import link provides access to the purchased snapshot; it does not include installation or configuration by ByteMarkDigi unless you have separately purchased that service.
Do not publish, forward, or otherwise distribute a private import link except as permitted under the applicable usage license in Section 6.
5. Customer Responsibilities
To use a snapshot, you are responsible for:
Maintaining an eligible HighLevel account or sub-account.
Reviewing the snapshot’s included components and adapting its settings, content, and workflows to your business.
Connecting and maintaining any required domains, calendars, email or telephone services, payment accounts, integrations, and other third-party services.
Obtaining required consents and complying with laws and platform rules that apply to your marketing, communications, customer information, and business operations.
Testing the system in your own environment before relying on it for live business activity.
If you purchase Installation & Configuration, you must also provide accurate business information, suitable branding materials, necessary approvals, and temporary access to the agreed HighLevel sub-account. Do not send account passwords by ordinary email. We will coordinate an appropriate access method with you.
Delays in receiving required information, access, or approvals may delay installation. We may pause work until the necessary items are provided.
You remain responsible for your HighLevel account, its ongoing operation, your business decisions, and your communications with your own customers.
6. Snapshot License and Permitted Use
6.1 License grant.
Upon full payment, ByteMarkDigi grants the purchaser a non-exclusive, non-transferable license to import and use the purchased snapshot within one HighLevel agency account controlled by the purchaser. The license permits ongoing use and customization of the snapshot across multiple sub-accounts within that agency, including sub-accounts operated for the purchaser’s clients.
6.2 Client services.
The purchaser may charge clients for services involving the installation, customization, configuration, hosting, or management of the snapshot within the licensed agency. Those services do not transfer the snapshot license to the client or grant the client a right to redistribute the snapshot.
6.3 Prohibited redistribution.
The purchaser may not sell, sublicense, share, publish, or distribute the snapshot itself, its private import link, or a substantially equivalent repackaged version to another agency or third party. The purchaser may not list the snapshot as a standalone digital product or include it in a product offered for redistribution without ByteMarkDigi’s prior written permission.
6.4 Additional agencies.
A separate purchase is required to import or use the snapshot in another independently controlled HighLevel agency account. Moving a client’s installed system to an independently controlled agency, where permitted by the platform, requires an appropriate license for that destination agency.
6.5 Ownership and platform requirements.
ByteMarkDigi retains ownership of its original snapshot materials. The purchase grants usage rights under this section, not ownership of the underlying intellectual property. Use remains subject to applicable HighLevel terms and technical restrictions.
7. Snapshot Refunds and Digital Product Issues
Cancellation before delivery.
You may cancel your snapshot purchase for a full refund at any time before ByteMarkDigi sends your private snapshot import link. To request cancellation, email [email protected] with your order details. If we receive your cancellation request before sending the link, we will cancel the order and refund the full snapshot purchase price to your original payment method.
After delivery.
Because a snapshot is a digital product that can be imported and retained after delivery, snapshot purchases are non-refundable once ByteMarkDigi has sent the private import link to the email address provided at checkout. If you receive the wrong snapshot, the link does not work, or the product materially differs from its description, contact [email protected] so we can investigate and provide an appropriate remedy. Nothing in this policy limits rights or remedies required by applicable law.
8. Installation & Configuration: Scheduling, Cancellation, and Completion
8.1 Getting Started
After you purchase Snapshot Installation & Configuration, ByteMarkDigi will email you a setup questionnaire and instructions for providing the business information, materials, approvals, and HighLevel sub-account access needed to perform the service.
The $297 one-time installation fee covers one purchased ByteMarkDigi snapshot installed and configured in one eligible HighLevel sub-account, as described in Section 2.3.
We will coordinate the installation schedule after receiving the required information and confirming that the designated sub-account is eligible. Any estimated completion date depends on your timely responses, required approvals, and the availability of relevant third-party services.
8.2 Work Outside the Included Service
If your requested work falls outside the purchased Installation & Configuration package, we will explain the additional scope and any proposed charge before performing that work. We will not charge you for additional work without your agreement.
8.3 Cancellation Before Work Begins
You may cancel your Installation & Configuration purchase for a full refund of $297 at any time before installation work begins.
To request cancellation, email [email protected] with your order details. We will confirm whether work has begun and notify you of the applicable refund.
8.4 Cancellation After Work Begins
If you cancel after installation work has begun, ByteMarkDigi will refund the portion of the $297 fee attributable to work not yet completed.
For cancellation and refund purposes, the installation service is divided into the following stages:
| Work completed at cancellation | Amount retained | Refund |
|---|---|---|
| No installation work has begun | $0 | $297 |
| Stage 1: Account review and setup preparation completed | $49 | $248 |
| Stage 2: Snapshot import and initial configuration completed | $149 | $148 |
| Stage 3: Remaining configuration, testing, walkthrough, and handoff completed | $297 | $0 |
The amounts above are cumulative, not additional charges. For example, if Stage 2 is complete when you cancel, the total amount retained is $149, not $49 plus $149.
A stage is considered complete for refund purposes only when the work described for that stage has been completed. Starting a stage does not, by itself, make the full fee for that stage non-refundable.
If you cancel while a stage is in progress, we will retain the amount attributable to previously completed stages and refund the remaining balance. We will provide a brief explanation of the completed work and the refund calculation.
Approved additional work, if any, is governed by the separate terms agreed to for that work.
8.5 Missing Information, Access, or Approvals
You are responsible for providing the information, materials, account access, and approvals reasonably needed to perform the purchased service.
If required items are missing, ByteMarkDigi may pause installation and email you identifying what is needed to proceed.
If you have not supplied the requested items within 30 calendar days after that notice, ByteMarkDigi may close the installation project. Closing the project does not automatically result in forfeiture of the full installation fee.
If the project is closed under this section, we will calculate any refund using the completed-stage amounts in Section 8.4 and provide a brief explanation of the work completed and any amount retained. You may contact us to discuss resuming the project, subject to availability and any additional work that may be required. Any new charges will be disclosed for your approval before additional work begins.
8.6 Completion and Handoff
The installation service is considered complete when the agreed snapshot has been installed and configured to the extent permitted by the information, access, approvals, and third-party connections you have provided; functional testing of the included setup has been performed; and ByteMarkDigi has provided the agreed walkthrough and handoff.
We will identify any outstanding actions that remain your responsibility, such as connecting or maintaining third-party accounts, subscriptions, domains, telephone or email services, or providing approvals that were not available during installation.
Completion of the purchased service does not include ongoing management, maintenance, or support unless separately agreed in writing.
8.7 Refund Processing and Applicable Rights
Approved refunds will be issued to the original payment method. The time it takes for the refund to appear in your account may depend on your payment provider.
Nothing in this section limits any cancellation, refund, or other rights or remedies that cannot lawfully be excluded.
9. No Guarantee of Business Results
Snapshots and installation services are tools intended to support business operations. Actual results depend on factors outside ByteMarkDigi’s control, including your market, offer, pricing, traffic, advertising, staff, follow-up practices, account configuration, and third-party services.
We do not guarantee any number of leads, calls, appointments, customers, sales, revenue, profits, or other business outcomes.
You are responsible for reviewing and approving your system’s content and operation before using it with customers or prospects.
10. Intellectual Property
Unless otherwise stated, the Website and ByteMarkDigi-created product materials—including original text, designs, branding, and other content—are owned by ByteMarkDigi or used with permission.
Your purchase does not grant ownership of the Website, ByteMarkDigi trademarks, or materials outside the license expressly provided with the purchased product.
HighLevel and other third-party names, trademarks, platforms, and materials belong to their respective owners. ByteMarkDigi is an independent seller of its described products and services and does not claim ownership of third-party platforms.
11. Acceptable Use
You agree not to use the Website, snapshots, or services to violate applicable law, infringe another party’s rights, send unlawful or unauthorized communications, interfere with platform security, or engage in fraudulent activity.
You are responsible for ensuring that your use of any included forms, workflows, messaging, tracking, and customer data complies with the laws and third-party terms applicable to your business.
We may suspend access to our services or decline further work where reasonably necessary to address unlawful use, fraud, threats to security, or material violations of these Terms, subject to applicable law and any refund rights.
12. Third-Party Services and Availability
The Website and purchased products may depend on third-party providers, including HighLevel, payment processors, email providers, hosting services, and other integrations.
Third-party services may change their features, pricing, policies, technical requirements, or availability. ByteMarkDigi cannot guarantee uninterrupted access to those services or that a snapshot will remain compatible with every future platform change.
Any third-party charges are your responsibility unless expressly included in the product or service description.
13. Disclaimer of Warranties
To the extent permitted by applicable law, the Website, digital products, and services are provided without warranties beyond those expressly stated in these Terms or the applicable product or service description.
We do not warrant that the Website or third-party platforms will operate without interruption or error, or that a snapshot will meet every individual business requirement.
This section does not exclude any warranty or consumer protection that cannot lawfully be excluded.
14. Limitation of Liability
To the extent permitted by applicable law, ByteMarkDigi will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, business opportunities, or data arising from use of the Website, products, or services.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
15. Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy, available through the Website.
When you purchase Installation & Configuration, we may need business details, branding materials, account-access information, and other information necessary to perform the agreed work. We will use that information to provide the purchased service and for other purposes described in the Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a revised “Last updated” date.
For a purchase already completed, the Terms applicable at the time of that purchase will govern that transaction unless a change is required by law or you expressly agree to the updated terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
If a dispute arises, please contact [email protected] first so we can attempt to resolve it informally.
Nothing in these Terms removes rights or remedies that cannot lawfully be waived.
18. Severability and Waiver
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
A failure by ByteMarkDigi to enforce a provision on one occasion does not waive its right to enforce that provision later.
